These general terms and conditions of sale (hereinafter the "General Terms and Conditions") apply to all purchases made by an internet user/natural person (hereinafter the "CUSTOMER") on the website www.lamiellerieemporium.com (hereinafter the "SITE"), 438 Boulevard Gambetta, Aubenas, 07200. IMPORTANT

To purchase a KNIFE PRODUCT, the CUSTOMER must be at least 18 years old and have legal capacity or, if a minor, be able to provide proof of the consent of their legal representatives.

Any order placed on the Website necessarily implies the unconditional acceptance by the

CUSTOMER of these General Terms and Conditions.

Article 1. Definitions

The terms used below have the following meanings in these General Terms and Conditions:

"CUSTOMER": refers to the contracting party of La Miellerie Emporium, who guarantees that they are a consumer as defined by French law and case law. As such, it is expressly provided that the CUSTOMER acts outside of any usual or commercial activity.

"DELIVERY": refers to the initial presentation of the PRODUCTS ordered by the CUSTOMER to the delivery address indicated when ordering.

"PRODUCTS": refers to all products available on the WEBSITE.

"TERRITORY" : refers to Metropolitan FRANCE, French Overseas Territories, and the rest of the world.

Article 2. Purpose

These General Terms and Conditions govern the sale of

PRODUCTS by La Miellerie Emporium to its CUSTOMERS.

The CUSTOMER is clearly informed and acknowledges that the SITE is intended for consumers and that professionals must contact La Miellerie Emporium's sales department to benefit from separate contractual terms and conditions.

Article 3. Acceptance of the General Terms and Conditions

The CUSTOMER undertakes to carefully read and accept these General Terms and Conditions before paying for an order for PRODUCTS placed on the SITE.

These General Terms and Conditions are referenced at the bottom of each page of the SITE by means of a link and must be consulted before placing an order. The CUSTOMER is encouraged to carefully read, download, and print the General Terms and Conditions, and retain a copy.

La Miellerie Emporium advises the CUSTOMER to read the General Terms and Conditions each time they place a new order. The latest version of these Terms and Conditions applies to all new orders for

PRODUCTS.

By clicking the first button to place an order and then the second to confirm the order, the CUSTOMER acknowledges having read, understood, and accepted the General Terms and Conditions without limitation or condition.

Article 4. Purchasing Products on the SITE

To purchase a KNIFE PRODUCT, the CUSTOMER must be at least 18 years old and have legal capacity or, if a minor, be able to provide proof of the consent of their legal representatives.

The CUSTOMER will be asked to provide information that can identify them by completing the form available on the SITE. The symbol (*) indicates mandatory fields that must be completed for the CUSTOMER's order to be processed by La Miellerie Emporium. The CUSTOMER can check the status of their order on the

SITE. DELIVERIES can, if necessary, be tracked using the online tracking tools of certain carriers. The CUSTOMER may also contact La Miellerie Emporium's sales department at any time by email at

lamielleriedelargentiere@gmail.com to obtain information on the status of their order.

The information the CUSTOMER provides to La Miellerie Emporium when placing an order must be complete, accurate, and up-to-date. La Miellerie Emporium reserves the right to ask the CUSTOMER to confirm, by any appropriate means, their identity, eligibility, and the information provided.

Unless expressly stated otherwise on the SITE, all PRODUCTS sold by La Miellerie Emporium are new and comply with current European legislation and the standards applicable in France.

Article 5.2. Ordering Procedure

PRODUCT orders are placed directly on the SITE. To place an order, the CUSTOMER must follow the steps described below (please note, however, that depending on the CUSTOMER's home page, the steps may vary slightly).

5.2.1. PRODUCT Selection and Purchase Options

The CUSTOMER must select the PRODUCT(s) of their choice by clicking on the relevant PRODUCT(s) and choosing the desired characteristics and quantities. Once the PRODUCT has been selected, it will be placed in the CUSTOMER's shopping cart. The CUSTOMER can then add as many PRODUCTS as they wish to their cart.

5.2.2. Orders

Once the PRODUCTS have been selected and placed in their cart, the CUSTOMER must click on the cart and verify that the contents of their order are correct. If the CUSTOMER has not already done so, they will then be prompted to log in or register.

Once the CUSTOMER has validated the contents of their shopping cart and logged in/registered, an automatically completed online form will be displayed, summarizing the price, applicable taxes, and, where applicable, delivery charges.

The CUSTOMER is invited to check the contents of their order (including the quantity, characteristics, and references of the PRODUCTS ordered, the billing address, the payment method, and the price) before confirming its contents.

The CUSTOMER may then proceed to pay for the PRODUCTS by following the instructions on the

SITE and provide all the information necessary for billing and DELIVERY of the PRODUCTS.

For PRODUCTS for which options are available, these specific references appear when the correct options have been selected. Orders placed must include all the information necessary for proper processing.

The CUSTOMER must also select the delivery method chosen.

5.2.3. Acknowledgment of Receipt

Once all the steps described above have been completed, a page will appear on the SITE acknowledging receipt of the CUSTOMER's order. A copy of the order acknowledgment will be automatically sent to the CUSTOMER by email, provided the email address provided via the registration form is correct.

The Emporium Honey Farm does not send order confirmations by post or fax.

5.2.4. Billing

During the order process, the CUSTOMER must enter the necessary billing information (the asterisk (*) indicates mandatory fields that must be completed for the CUSTOMER's order to be processed by La Miellerie Emporium).

The CUSTOMER must clearly indicate all information relating to DELIVERY, in particular the exact DELIVERY address, as well as any access code to the DELIVERY address.

For delivery by MONDIAL RELAY, the RELAY POINT closest to the CUSTOMER's address will be used unless the CUSTOMER contacts La Miellerie Emporium to request a different RELAY POINT address.

The CUSTOMER must also specify the chosen payment method.

Neither the order form that the CUSTOMER creates online nor the order acknowledgment that La Miellerie Emporium sends to the CUSTOMER by email constitute an invoice. Regardless of the order or payment method, Once the payment method has been used, the CUSTOMER will receive the original invoice upon

DELIVERY of the PRODUCTS, inside the package.

The CUSTOMER must select the PRODUCT(s) of their choice by clicking on the relevant PRODUCT(s) and choosing the desired characteristics and quantities. Once the PRODUCT(s) is selected, it will be added to their shopping cart. The CUSTOMER may then add as many PRODUCTS as they wish to their shopping cart.

5.2.2. Orders

Once the PRODUCTS have been selected and added to their shopping cart, the CUSTOMER must click on the shopping cart and verify the accuracy of the contents of their order. If they have not already done so, they will be prompted to log in or register.

Once the contents of the shopping cart have been validated and the customer has logged in/registered, an automatically completed online form will be displayed, summarizing the price, applicable taxes, and, where applicable, delivery charges.

The CUSTOMER is invited to check the contents of their order (including the quantity, characteristics, and references of the PRODUCTS ordered, the billing address, the payment method, and the price) before confirming it.

The CUSTOMER may then proceed to pay for the PRODUCTS by following the instructions on the SITE and provide all the information necessary for billing and DELIVERY of the PRODUCTS.

For PRODUCTS for which options are available, these specific references appear when the appropriate options have been selected. Orders placed must include all the information necessary for their proper processing.

The CUSTOMER must also select the chosen delivery method.

5.2.3. Acknowledgment of Receipt

Once all the steps described above have been completed, a page will be displayed on the SITE acknowledging receipt of the CUSTOMER's order. A copy of the order acknowledgment will be automatically sent to the CUSTOMER by email, provided the email address provided via the registration form is correct.

La Miellerie Emporium does not send order confirmations by post or fax.

5.2.4. Billing

During the order process, the CUSTOMER must enter the necessary billing information (the asterisk (*) indicates mandatory fields for the order to be processed by La Miellerie Emporium).

The CUSTOMER must clearly provide all information regarding DELIVERY, including the exact DELIVERY address and any access codes to that address.

For delivery by MONDIAL RELAY, the PICK-UP POINT closest to the CUSTOMER's address will be used, unless the CUSTOMER contacts La Miellerie Emporium to request a different PICK-UP POINT address.

The CUSTOMER must also specify the chosen payment method.

Neither the order form created online by the CUSTOMER nor the order acknowledgment sent by email by La Miellerie Emporium constitute an invoice. Regardless of the order or payment method, once the payment method has been used, the CUSTOMER will receive the original invoice upon DELIVERY of the PRODUCTS, inside the package.

Article 7. Payment

Article 7.1. Payment Methods

The CUSTOMER may pay for their PRODUCTS online on the SITE using the methods offered by La Miellerie Emporium.

The CUSTOMER guarantees to La Miellerie Emporium that they have all the required authorizations to use the chosen payment method.

La Miellerie Emporium will take all necessary measures to guarantee the security and confidentiality of data transmitted online as part of online payment on the SITE.

It is hereby specified that all payment information provided on the SITE is transmitted to the SITE's bank and is not processed on the SITE.

Article 7.2. Payment Date

In the event of a single payment by credit card, the CUSTOMER's account will be debited as soon as the PRODUCTS are ordered on the SITE.

In the event of partial DELIVERY, the total amount will be debited from the CUSTOMER's account as soon as the PRODUCTS are ordered on the SITE.

If the CUSTOMER decides to cancel their order for unavailable PRODUCTS, the refund will be made in accordance with the last paragraph of Article 5.5 of these General Terms and Conditions.

Article 7.3. Late or Refused Payment

If the bank refuses to debit a card or other payment method, the CUSTOMER must contact La Miellerie Emporium Customer Service to pay the order using another valid payment method.

In the event that, for any reason whatsoever, whether due to a chargeback, refusal, or otherwise, the transmission of the funds owed by the CUSTOMER proves impossible, the order will be canceled and the sale automatically terminated.

Article 8. Proof and Archiving

Any contract entered into with the CUSTOMER for an order exceeding €120 including VAT will be archived by the SELLER for a period of ten (10) years in accordance with Article

134-2 of the French Consumer Code.

La Miellerie Emporium agrees to archive this information in order to monitor transactions and produce a copy of the contract at the CUSTOMER's request.

In the event of a dispute, La Miellerie Emporium will have the opportunity to prove that its electronic tracking system is reliable and that it guarantees the integrity of the transaction.

Article 9. Transfer of Ownership

La Miellerie Emporium remains the owner of the PRODUCTS delivered until full payment is received from the CUSTOMER.

The above provisions do not prevent the transfer to the CUSTOMER, upon receipt by the CUSTOMER, or by a third party designated by the CUSTOMER other than the carrier, of the risks of loss or damage to the PRODUCTS subject to the retention of title, as well as any risks of damage they may cause.

Article 10. Delivery

The terms of DELIVERY of the PRODUCTS are set out in the "Delivery Policy" referred to in Appendix 2 hereof and accessible at the bottom of each page of the SITE via a hyperlink.

Article 11. Packaging

The PRODUCTS will be packaged in accordance with current transport standards to ensure maximum protection for the PRODUCTS during DELIVERY.

CUSTOMERS undertake to comply with the same standards when returning PRODUCTS under the conditions set out in Appendix 1 - Withdrawal Policy.

Article 12. Warranties

Article 12.1. Conformity Guarantee

La Miellerie Emporium is required to deliver a compliant PRODUCT, meaning one that is fit for the intended use of a similar product and matches the description given on the SITE. This conformity also implies that the PRODUCT has the qualities that a buyer can legitimately expect, given the public statements made by La Miellerie Emporium, including in advertising and on labeling.

In this context, La Miellerie Emporium may be liable for defects of conformity existing at the time of delivery and for defects of conformity resulting from packaging, assembly instructions, or installation when it has been responsible for this or has been carried out under its responsibility.

The action resulting from the lack of conformity is prescribed by clause (1) and begins upon delivery of the PRODUCT.

In the event of a lack of conformity, the CUSTOMER may request replacement or repair of the PRODUCT, at their discretion. However, if the cost of the CUSTOMER's choice is clearly disproportionate to the other possible option, given the value of the PRODUCT or the extent of the defect, La Miellerie Emporium may issue a refund, regardless of the option chosen by the Customer.

In the event that replacement or repair is not possible, La Miellerie Emporium undertakes to refund the price of the PRODUCT within 30 days of receipt of the returned PRODUCT, in exchange for the CUSTOMER returning the PRODUCT to the following address: 40 Avenue de la République, 07110 Largentière, France.

Article 12.2. Warranty for Hidden Defects

La Miellerie Emporium is bound by the warranty for hidden defects in the PRODUCT sold.

Article 16. Intellectual Property

All visual and audio elements of the SITE, including the underlying technology used, are protected by copyright, trademark law, and/or patents. These elements are the exclusive property of La Miellerie Emporium.

Anyone publishing a website and wishing to create a direct hyperlink to the SITE must request written authorization from La Miellerie Emporium.

This authorization from La Miellerie Emporium will under no circumstances be granted permanently. This link must be removed at the request of La Miellerie Emporium. Hyperlinks to the SITE using techniques such as framing or in-line linking are strictly prohibited.

Article 17. Validity of the General Terms and Conditions

Any change in applicable legislation or regulations, or any decision by a competent court invalidating one or more clauses of these General Terms and Conditions, shall not affect the validity of these General Terms and Conditions. Such a change or decision shall in no way authorize CUSTOMERS to disregard these General Terms and Conditions.

All conditions not directly addressed herein shall be governed in accordance with the customary practice in the retail sector for companies whose registered office is located in France.

Article 18. Modification of the General Terms and Conditions

These General Terms and Conditions apply to all purchases made online on the SITE, as long as the SITE is available online.

The General Terms and Conditions are dated precisely and may be modified and updated by La Miellerie Emporium at any time. The applicable General Terms and Conditions are those in effect at the time of the order.

Suggested changes to the General Terms and Conditions will not apply to PRODUCTS already purchased.

Article 19. Jurisdiction and Applicable Law

These General Terms and Conditions, as well as the relationship between the CLIENT and La Miellerie Emporium, are governed by French law.

In the event of a dispute, the Commercial Court of Romans shall have sole jurisdiction. However, prior to any recourse to arbitration or state courts, negotiation shall be favored in a spirit of loyalty and good faith with a view to reaching an amicable agreement in the event of any dispute relating to this contract, including its validity.

The party wishing to initiate the negotiation process must inform the other party by registered letter with acknowledgment of receipt, indicating the elements of the dispute. If the parties fail to reach an agreement within fifteen (15) days, the dispute shall be submitted to the competent court designated below.

Throughout the negotiation process and until its conclusion, the parties shall refrain from taking any legal action against each other and for the dispute that is the subject of the negotiation. As an exception, the parties are authorized to refer the matter to the summary court or to request the issuance of an order upon request. Any action before the summary court or the implementation of a procedure upon request shall not entail any waiver by the parties of the amicable settlement clause, unless expressly requested otherwise.

Article 20. Legislation Outside France

The items offered comply with the legislation in force in France. La Miellerie Emporium cannot be held liable for non-compliance with the legislation of the country to which the items are delivered. It is therefore your responsibility to check with local authorities regarding the import or use of the items you plan to order.

All taxes specific to certain countries (customs duties, VAT, and other taxes, etc.) are the customer's responsibility. No returns will be accepted for non-payment of customs duties.

APPENDIX 1

CANCELLATION POLICY

Cancellation Principle

The CUSTOMER has the right to return or deliver the PRODUCT to: La Miellerie Emporium or a person designated by the latter, without undue delay and no later than seven (7) days after communicating their decision to cancel, unless La Miellerie Emporium offers to collect the PRODUCT itself.

IMPORTANT

Personal hygiene products cannot be returned for health and safety reasons.

Cancellation Period

The cancellation period expires seven (7) calendar days after the day on which the CUSTOMER, or a third party other than the carrier and designated by the CUSTOMER, takes physical possession of the PRODUCT.

If the CUSTOMER has ordered multiple PRODUCTS via a single order resulting in multiple DELIVERIES (or in the case of an order for a single PRODUCT delivered in multiple batches), the withdrawal period will expire fourteen (14) calendar days after the day on which the CUSTOMER, or a third party other than the carrier and designated by the CUSTOMER, takes physical possession of the last PRODUCT delivered. If the CUSTOMER's order relates to multiple PRODUCTS and these PRODUCTS are delivered separately, the withdrawal period will expire seven (7) days after the day on which the CUSTOMER, or a third party other than the carrier and designated by the CUSTOMER, takes physical possession of the last

PRODUCT.

Notification of the Right of Withdrawal

To comply with the withdrawal period, the CUSTOMER must send their communication regarding their exercise of the right of withdrawal before the expiration of the withdrawal period.

Effects of Withdrawal

In the event of withdrawal by the CUSTOMER, La Miellerie Emporium undertakes to reimburse all amounts paid, including delivery costs, without undue delay and, in any event, no later than seven (7) days from the day La Miellerie Emporium is informed of the CUSTOMER's intention to withdraw.

La Miellerie Emporium will make the reimbursement using the same means of payment as the CUSTOMER used for the initial transaction, unless the CUSTOMER expressly agrees to a different method. In any event, this reimbursement will not incur any fees for the CUSTOMER.

La Miellerie Emporium may defer reimbursement until receipt of the goods or until the CUSTOMER has provided proof of shipment of the goods, whichever comes first.

Return Policy

The CUSTOMER must, without undue delay and, in any event, no later than seven (7) days after communicating their decision to withdraw from this contract, return the goods to:

This deadline is deemed to have been met if the CUSTOMER returns the goods before the expiry of the fourteen (14) day period.

Return Costs

The CUSTOMER must bear the direct costs of returning the goods.

Condition of Returned Goods

The PRODUCT must be returned in accordance with La Miellerie Emporium's instructions and must contain all the accessories delivered.

The CUSTOMER is only liable for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the PRODUCT. In other words,

APPENDIX 2:

DELIVERY POLICY

Unless the nearest Relay Point has been automatically processed, the PRODUCTS are shipped to the delivery address(es) indicated by the CUSTOMER during the order process. Any additional shipping costs must be borne by the customer.

Shipping Times

The timeframes for preparing an order and then issuing the invoice, before shipping PRODUCTS in stock, are indicated on the SITE. These times do not include weekends or public holidays.

An email will be automatically sent to the CUSTOMER when the

PRODUCTS are shipped, provided the email address provided on the registration form is correct.

Delivery Times & Costs

During the order process, La Miellerie Emporium informs the CUSTOMER of the possible shipping times and options for the PRODUCTS purchased. Shipping costs are calculated based on the delivery method. The amount of these costs will be payable by the CUSTOMER in addition to the price of the PRODUCTS purchased. Details of delivery times and costs are provided on the SITE.

DELIVERY TERMS

Except for Mondial Relay deliveries where the item is delivered to a Relay Point, the package will be delivered to the CUSTOMER against signature and upon presentation of proof of identity.

In the event of absence, a delivery note will be left for the CUSTOMER to collect the package from their post office.

DELIVERY ISSUES

The CUSTOMER is informed of the delivery date when choosing the carrier, at the end of the online ordering process, before confirming the order.

It is specified that deliveries will be made within a maximum of thirty (30) days. Failing this, the CUSTOMER must formally notify La Miellerie Emporium to deliver within a reasonable timeframe. In the event of non-delivery within this timeframe, the CUSTOMER may terminate the contract.

Miellerie Emporium will reimburse the CUSTOMER, without undue delay from receipt of the termination letter, the total amount paid for the PRODUCTS, including taxes and delivery charges, using the same payment method used by the CUSTOMER to purchase the PRODUCTS.

Miellerie Emporium is responsible until delivery of the PRODUCT to the CUSTOMER. It is reminded that the

CUSTOMER has three (3) days to notify the carrier of any damage or partial loss noted upon delivery.

APPENDIX 3:

DATA PROTECTION

The data controller is Miellerie Emporium.

Purposes

The personal data collected on our website is used to process orders and manage the commercial relationship (deliveries, invoices, after-sales service).
We may also use your data for advertising purposes, either after obtaining your express consent or within the limits permitted by law. We may also use your data to meet our legal and/or regulatory obligations, if applicable.

Sales Marketing by Email

If you no longer wish to receive sales marketing by email, you can let us know at any time by sending your request via our contact form.

Recipients

The recipients of your personal data are, where applicable, our payment or payment security providers, our delivery providers, and our business partners. Where required by law, your consent will be obtained or you will be given the opportunity to refuse any data transmission.
